This is my notice to call for special meeting Editor: I am also sending this email to Shasta County Sheriff Tom Bosenko, Pit River Tribal Ajumawi Council Phillip Raglin, and Illmawi Council Alternate Randy Wolfin. Today I got a call from a tribal member who informed me that a brick was thrown through the car windows of both Pit River Tribal Chairperson Jessica Jim and Pit River Tribal Atsugewi Alternate Sheila Montgomery. I have not talked to Jessica as she does not have a phone, and I am hoping that Randy Wolfin can confirm this for us. Since the August 2007 Pit River Tribal Election in which 5 council members were voted out there has been much turmoil in the Pit River Tribal Community caused by those Council People whose Council term expired on8/24/07. Specifically ex-Ajumawi Council Lillian Lego, her daughter ex- Ajumawi Council Alternate Sharon Elmore, her husband ex-Madesi Council Matt Elmore, ex-Atwamsini Council Mary Preston and her daughter Astarawi Council Patricia Preston. Tribal members have taken video of Sharon Elmore disrupting Tribal meetings. At two separate meetings of the Council after Sharon’s Council term had expired, the Sheriff was called on Sharon Elmore. In one case Sharon Elmore was making menacing threats against me and my family. After that meeting I and other Madesi band members met with the Bureau of Indian Affairs Superintendent Dr. Virgil Akins who told us that I was the Pit River Tribal Council Person that he would recognize for the people voted for me. He advised me to keep attending the Council meetings, but to notify the Sheriff prior to attending due to the threats. In the other incident which was on 9/7/07 Sharon left the gaming meeting due to the Sheriff being called on her again. She stayed outside the building of this meeting for some time before going over to the Pit River Tribal Office at 37118 Main St. in Burney and locking herself in with other ex-council (Lillian Lego, Mary Preston), Tribal staff, and 3 real Council people (Raymond Alvarez, Melvin Wolfin & Patricia Preston). A tribal member has video of this lock down. A man on the video stated that Tribal Administrator Bob Boyce ordered this lock down of the Tribal Office. The Pit River Tribal Membership actually voted to fire this Tribal Administrator Bob Boyce, but these same ex-Council people who are supposed to be representatives of the people actually ignored this decision and have continued to employ him against the will of the voting membership. Bob Boyce is also a party in the discrimination and atrocious mistreatment against members of the Pit River Tribe. There is a clip of Boyce on the internet (youtube) showing him taking a swing at a small lady protesting outside the Tribal Office. He has put it in the media and in tribal newsletters and band letters that he was the one that was attacked and vilified all the protesters. Boyce is at least a foot taller and 100 lbs heavier than the lady he targeted in the video and seemed to be taunting the protestors and obviously was at the Tribal Office so he should have been working and had no business being outside. The Sheriff was called that day too, and the protestor told me that they asked to press charges against Boyce for the assault, but the Sheriff refused to let her do so and said that they would review the security camera tape and get back to her. The Sheriff still has not gotten back to her and has continued to give her the run around. Boyce, ex-council, and their supporters have even pursued legal action against the protestors, our Tribal Chairperson, and ex-councilperson Marina Martinez in an attempt to intimidate any others that may disagree with them. Tribal members have reported to me that one of the Burney Sheriffs is actually the land lord of Matt &Sharon Elmore, and therefore they believe the sheriff to be biased. Bob Boyce has also retaliated against individuals that disagree with him by slandering Tribal members in the media, Tribal newsletter, and Tribal Band news letters from Matt Elmore and Sharon Elmore. There is also a sickening slander website that Boyce, and Mr, & Mrs. Elmore have been linked to in our community called pitrivertruths.info. The website hides your identity and you need a subpoena to find out who is posting the slander and leaking sensitive info. It is clear that the Pit River people do not recognize Bob Boyce as the Tribal Administrator or the ex-council people that they voted out due to this ongoing improper behavior. On 9/21/07 the new Council had a meeting in Burney. On the same day Bob Boyce and the ex-council had a meeting in Alturas. Sharon Elmore’s sister Leta Nalton was spying on us at the Burney meeting. I have been informed by a Tribal member who was video taping the Alturas meeting that it was captured on video, the call from Leta Nalton, who was calling the ex-council to tell them who was attending the Burney meeting. Leta reported that Pit River Tribal Chairperson Jessica Jim and Atsugewi Council Alternate Sheila Montgomery were at the meeting. Sheila was not at the meeting, but the next night both Sheila Montgomery and Jessica Jim had a brick thrown through their car windows. To complicate matters further neither of the new Ajumawi Council people Phillip Raglin or Rile Webster who were elected by their band to replace Sharon Elmore and Lillian Lego has attended any meetings after the seating of the new council on 8/24/07. So I am sending this email to him as well to ask for a response from Phillip Raglin on this matter. Phillip Raglin told me that he was informed by tribal office staffer and tribal member June Avelar that his term started on 8/24/07. I informed Phillip also in a telephone conversation on 8/23/07 in which Phillip said he would be at the monthly meeting around 10:30am the next day, but he did not show to represent Ajumawi. He also would not give me his alternate Rile Webster’s phone number, but I would also like to know Rile’s position on this matter as well. The next time I talked to Phillip he said that he was not resigning as Ajumawi Council as Sharon Elmore had been reporting. He said that his elders told him to wait 30 days. It was 30 days last Tuesday and Phillip still has not come forward to fulfill his elected duties. I also understand that the Illmawi band had a band meeting on Saturday and expressed to their Council Representative Melvin Wolfin and Alternate Randy Wolfin that they did not want a new election. I understand they put this in writing and signed it. I also understand that the illmawi band is suggesting that the bands in dispute step away from the Council table. But as everyone knows there are no valid band disputes, just some ex-council people who are refusing to believe they have been replaced. And to deny an entire band representation, when it is clear who was elected, is a violation of our rights. I am sending this email to Randy Wolfin to confirm his Band’s position in this matter. I also want to point out that these same council and ex-council people in question also signed an oath of office which they are also violating. Since I have been advised by the Bureau of Indian Affairs to notify the Sheriff prior to attending any Council meeting, this is my notice:9-21-07 Honorable Tribal Chairperson Jessica Jim, Per the Pit River Tribal Constitution: ARTICLE XI – MEETINGS Section 1. Tribal Council. c. Special Meetings. Special meeting of the Tribal Council may be called by the Chairman at his discretion, or shall be called by the Chairman upon the written request of at least three (3) members of the Tribal Council; provided, that the reason for the meeting is stated in the request and that each member of the Tribal Council is given at least 24 hours advance notice of any special meeting. Upon refusal by the Chairman to call a special meeting with 24 hours upon the written request of three (3) members of the Tribal Council, those members who requested the special meeting may proceed to call and conduct the special meeting. Therefore, this is my written Tribal Council request for a meeting on Friday 28,2007 at the Gepetto’s Pizza Restaurant meeting room at 37227 Main St., Burney, CA96013. From 11am to 3pm.The purpose of this meeting is to sign the resolution designating the Tribe’s signatories discussed in the 9/5/07 BIA letter to Jessica Jim, Chairperson Pit River Tribe. Per the BIA’s 9-12-07 letter “for the Agency (BIA)to accept a resolution from the Tribe it must be certified by the elected Tribal Chairperson and attested to by the acknowledged Secretary that the resolution was approved at a duly held Tribal Council meeting, and voted upon by band members authorized to vote.”-Brandy McDaniels, Madesi Council, Jesse Cardenas, Hammawi Council, Jolee George, Atsugewi Council. Obviously I have real and serious concerns about the safety of our Tribal Chairperson, Council members, Tribal members, and Tribal staff.
